Christkindlesmarkt Coming to Fellsmere, Florida December 6th & 7th

The process to reserve your space is as follows. All steps MUST be completed before your space is considered reserved:
1.) Read through the terms and conditions in its entirety.
2.) Look at the maps closely to determine where you would like to set up.
3.) Fill out the submission form completely and submit.
4.) Pay for your space using the convenient “Make Payment Here” Button. (You may have to come back to this page once you submit your application)
Remember that you must provide your own table chairs, and tent if you choose to use one. A tent is not required but is strongly suggested due to limited shade on property.
We will have a limited number of tables and chairs available the day(s) of the event. They are $15 for one table and two chairs. Supply is limited and it is first come/first serve.

Rules, Regulations & Terms Agreement for Vendors
1. Each vendor will review and agree to the vendor agreement prior to rental.
2. All sales Spaces are 15’ X 15’ and you must stay within these boundaries. All Farmer's Market and Food Vendor's Spots are 20' X 20'. You must use designated loading zone areas. Space rental does NOT include tables, chairs, or a tent. Vendors must supply these themselves. (A tent is suggested, but not required)
3. The cost for two-day locations at the Flea Market are: One 15 X 15 Space - $40, Two 15 X 15 Spaces are $60. Food Vendor & Farmers Market Locations are $45. The cost for one-day spaces are: 15 X15 Space - $30, Two 15 X 15 Spaces - $50, Food Vendor & Farmers Market locations are $35. The Dates are Friday December 6th and Saturday December 7th. The Market will be open for setup at 6am and will open for business at 9am. The Market will end business at 2pm.
4. Your Space is NOT reserved until it is paid for in FULL and you have reviewed and agreed to these terms and conditions.
5. All Space rentals are final and there will be no refunds given for no-shows or vendor cancellations. Refunds will only be issued if Fellsmere Chapel completely cancels the event in its entirety. (Postponing the event is NOT cancelling the event)
6. Signage, Advertising, and promotion of this Flea Market will be handled by Fellsmere Chapel and its staff. However, if you would be willing to help in getting the word out, contact us so that we can coordinate options.
7. Sale of food items is limited to agricultural products, processed foods, baked goods and fresh meats/eggs; and must comply with all Federal, State and local regulations. A copy of your license (if required) shall be kept at your booth at all times. Food sold for immediate consumption(concessions) is not permitted without prior authorization by Fellsmere Chapel.
8. All items for sale must be legal in the State of Florida. The sale of firearms, ammunition, explosives, tobacco, tobacco and/or vaping‐related items, and/or alcoholic beverages is PROHIBITED. The sale or display of counterfeit merchandise is strictly forbidden. Fellsmere Chapel staff reserves the right to restrict the sale of any items that they deem inappropriate. Fellsmere Chapel does not limit or restrict vendor categories (Unless deemed inappropriate), brand competition or pricing of items sold at the flea market. Fellsmere Chapel is not responsible for the enforcement of sales restrictions imposed by direct sale companies.
9. Vendors are responsible for complying with all Federal, State, and local regulations concerning sales tax. Vendors agree to follow all Indian River County and Fellsmere Chapel rules and policies.
10. No pets or live animals are permitted in the market area except for service animals with identification.
11. Vendors can begin to break down one (1) hour before closing at their own discretion. Vendors cannot bring their vehicles into the selling area until after closing. (2pm)
12. All items not sold must be taken by the sellers at tear‐down which is the hour following closing time. No one is permitted to leave any discarded merchandise, cartons, boxes or debris of any kind. All items must be removed from the Fellsmere Chapel facilities in your own vehicles. Vendors that leave garbage, products, or debris will be subject to a surcharge of $50 and/or refusal of future set up.
13. These rules and regulations may be modified and/or amended as needed without prior notice by Fellsmere Chapel. Performance of the agreement is contingent upon the ability of Felsmere Chapel to complete the same and is subject to Acts of God, labor troubles, disputes or strikes, accidents, government (federal, state, or municipal) requisitions, restrictions on travel, or transportation. In the event of a natural disaster or civil disturbance any and all rooms, buildings, and grounds may be ordered vacated by Indian River County, Sheriff's Department or the Fellsmere City Council.
14. Fellsmere Chapel Space is provided as is and Vendor is responsible to inspect spaces to be utilized and immediately report any concerns during the rental period. Fellsmere Chapel will not be held responsible for any losses, damages, or injuries. This refers to any loss, damage, or injury to persons or possessions that may occur at any function held on this property, from any cause, whatsoever, prior to, during, or after the period covered by this contract. Vendor will be responsible for the control and supervision of any employees or helpers in attendance during the use of the facility to ensure no harm is done to persons or property.
15. Hold Harmless/Indemnification Agreements: Please read carefully. The Vendor agrees to defend, indemnify and hold harmless Fellsmere Chapel, its officers, employees, agents and representatives from any claim, demand, suit, fine, loss, cost or expense or any damage which may be asserted, claimed or recovered against or from Fellsmere Chapel by reason of any damage to property, person or bodily injury, including death, sustained by any person connected with, the use of the facilities, and/or by the negligence of the Vendor, its agents, invitees, employees, officers or representatives.
16. Amendment: Farmer's Market Vendors and Food Vendors can have trailers/vehicles in the sales area if they are needed to properly set up and operate your business.
